What is a Power of Attorney?

A Power of Attorney is a document where you (the Donor) appoint an attorney (usually a family member or trusted friend) to make decisions on your behalf. At the time of making a Power of Attorney you must have mental capacity to make your own decisions. Once you have lost mental capacity it becomes impossible for you to make a Lasting Power of Attorney. The attorney is under a duty to always act in your best interests.
