Types of Lasting Power of Attorney
There are two types of Lasting Power of Attorney (LPA). (1) a Health & Care Decisions Lasting Power of Attorney and (2) a Financial Decisions Lasting Power of Attorney. The power under each Lasting Power of Attorney can only be exercised by your appointed attorney(s) when you have lost mental capacity and not before. You can make one or both lasting Power of Attorney.
This gives your trusted chosen attorney(s) power to make decisions about your healthcare and personal welfare.
This gives your trusted chosen attorney(s) power to make decisions about your property and financial affairs.
Complete Peace of Mind
You can inform your attorney(s) through your Lasting Power of Attorney how (should you lose mental capacity) you want decisions taken by setting out your wishes and preferences in your Lasting Power of Attorney.
Hopefully, your Lasting Power of Attorney will never be needed. But by having it in place you can ensure that if at any time in the future you are in a situation where you are for whatever reason unable to make decisions then member(s) of your family you have appointed as your attorney(s) have the power to make decisions on your behalf.
If you lose metal capacity and have not made a Lasting Power Attorney then no one can make decisions for you. Your family would need to apply to the Court of Protection to obtain an Order to appoint a Deputy – which can be time consuming and expensive.
